Tive Product Warranty

This limited warranty is provided by Tive, Inc. (“Tive”) to you as the original purchaser of a Tive product that is identified on the invoice reflecting the original purchase (the "Product"). Tive warrants that the Product, when delivered in its original packaging, will be free of defects in material and workmanship for a period of one (1) year from the date of original purchase (the “Warranty Period”). 

The determination of whether the Product is defective shall be made by Tive in its sole discretion with consideration given to the overall performance of the Product.

If Tive determines the Product is not in compliance with this limited warranty, Tive will elect, in its sole discretion, to either (a) to repair the Product, (b) replace the Product, or (c) credit or refund the net price paid to Tive for the defective Product. This limited warranty and your remedies will not apply to loss or damage to the Product caused by one or more of the following: negligence; abuse; misuse; mishandling; improper installation, storage, or maintenance; abnormal physical or environmental stress or conditions; damage due to fire, natural disaster, or acts of God; vandalism; civil disturbances; improper power supply; corrosive environment installations or use; induced vibration; integration or use with a third-party product or service not recommended or approved by Tive; accident; failure to follow installation, operating, maintenance, environmental, or other instructions or documentation provided by Tive; and any actions or events beyond Tive’s reasonable control or otherwise outside the design parameters of the Products.

THIS LIMITED WARRANTY IS VOID IF THE PRODUCT IS NOT USED FOR THE PURPOSE FOR WHICH IT IS DESIGNED OR IF IT IS REPAIRED OR ALTERED BY ANYONE OTHER THAN TIVE OR ITS AUTHORIZED REPRESENTATIVES.

Tive reserves the right to utilize new, reconditioned, refurbished, repaired, or remanufactured products or parts in the warranty repair or replacement process. Such products and parts will be comparable in function and performance to an original product or part, as determined by Tive in its sole discretion, and warranted for the remainder of the original Warranty Period.

In order to make a warranty claim, you must notify Tive in writing within sixty (60) days after your discovery of the defect or the expiration of the original Warranty Period, whichever occurs first. Upon receiving that notice, Tive may require you to promptly return the Product, freight and shipping insurance prepaid by you to a facility designated by Tive. THIS LIMITED WARRANTY ONLY APPLIES TO THE PRODUCT FOR THE ORIGINAL PURCHASER. This limited warranty is not applicable or transferrable to any subsequent owner, purchaser, or other transferee of the Product.

THE FOREGOING WARRANTY PROVISIONS ARE EXCLUSIVE AND ARE GIVEN AND ACCEPTED IN LIEU OF ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY AGAINST INFRINGEMENT AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL TIVE OR ITS AFFILIATES, SUCCESSORS, OR RESELLERS BE LIABLE FOR INCIDENTAL, COMPENSATORY, CONSEQUENTIAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES. TIVE’S AND ITS AFFILIATES’, SUCCESSORS’, OR RESELLERS’ AGGREGATE LIABILITY WITH RESPECT TO A DEFECTIVE PRODUCT SHALL IN ANY EVENT BE LIMITED TO THE MONIES PAID TO THEM FOR THAT DEFECTIVE PRODUCT.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, This limited warranty sets forth your exclusive remedy and Tive’s entire liability for any breach of this limited warranty OR RELATING TO THE PRODUCTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS AND RESTRICTIONS, AND THE LIMITATIONS AND RESTRICTIONS DESCRIBED HEREIN ONLY APPLY TO THE EXTENT PERMITTED BY LAW.

Tive reserves the right to modify this limited warranty from time to time. Any modification of this limited warranty shall be effective for all orders placed on or after the effective date of such revised warranty.
